Chriggy: Still, taking a case to the supreme court pretty much bankrupts any individual who needs to do so. So an unconstitutional law being passed still ruins lives, especially those who can’t afford to challenge things and can’t find a pro bono attorney.

In this case though, we are not talking about individuals. The people most likely to challenge are the major broadcast networks, who do indeed have the means and money and motivation to take a case all the way to the supreme court.
